  • Terms of Service

    Positively Living

    1. Overview

    These Terms of Trade outline the agreement between you and Positively Living. By engaging in services, you agree to the terms below.

    These terms are designed to support clarity, safety, and respectful working relationships for all clients.

    2. Services

    Positively Living provides:

    • Counselling and psychotherapy
    • Clinical supervision
    • Consulting and training
    • Workshops and group programs

    Services may be delivered via:

    • Telehealth
    • Phone
    • Text- based sessions (where approprate and agreed in advance)

    3. Bookings and Payment

    • All sessions must be booked in advance
    • An invoice will be issued following your appointment
    • Payment is required on the day of your appointment
    • Accounts must remain up to date for services to continue
    • Positively Living reserves the right to pause future appointments where invoices remain unpaid

    Accepted payment methods are outlined on your invoice.

    4. Late Payments

    • If payment has not been received, a reminder may be issued

    If invoices remain unpaid:

    • Future appointments will be paused until the account is up to date
    • Repeat late payments may result in a move to prepayment for future sessions
    • Continued non-payment may result in cessation of services

    We aim to work collaboratively and understand that difficulties can arise. Please reach out if you are experiencing challenges with payment.

    5. Cancellation Policy

    • 24 hours’ notice is required to cancel or reschedule
    • Cancellations with less than 24 hours’ notice will incur the full session fee
    • Non-attendance (no-shows) will incur the full fee

    Sessions are non-refundable within the 48-hour cancellation window.

    6. Late Attendance

    If you arrive late, your session will still end at the scheduled time

    The full session fee applies

    This ensures fairness to all clients.

    7. Telehealth

    For telehealth sessions:

    You are responsible for ensuring a private, safe, and stable environment

    A secure session link will be provided prior to your appointment

    If technical issues occur, reasonable efforts will be made to continue the session

    8. Confidentiality

    Your privacy is important.

    All services are delivered in accordance with professional and ethical standards. Information shared in sessions is confidential, except where disclosure is required by law or where there is a risk of harm to you or others.

    9. Recording and Privacy

    To protect the privacy and safety of all clients:

    • Recording of sessions (including audio, video, screenshots, or transcription) is not permitted without prior written consent from Positively Living
    • This applies to all formats, including telehealth, phone, and text-based sessions
    • Any unauthorised recording may result in immediate cessation of services

    Positively Living will not record sessions without your knowledge and consent.

    10. Scope of Service

    Positively Living provides trauma-informed, neurodivergent-affirming, person-centred support.

    Services do not include:

    • Crisis or emergency response
    • 24/7 support

    If you require urgent assistance, please contact emergency services or a crisis support service.

    11. Communication

    • Written communication is preferred where possible
    • Responses are typically provided during business hours
    • Urgent matters should not be directed via email or messaging

    12. NDIS and Third-Party Funding

    Where applicable:

    • You are responsible for ensuring your funding is available and appropriate
    • Any gaps or shortfalls in funding remain your responsibility
    • Invoices must be paid in accordance with these Terms of Trade

    NDIS pricing and conditions will align with current guidelines where relevant.

    13. Boundaries and Respect

    Positively Living is committed to providing a safe and respectful space.

    This includes:

    • Clear professional boundaries
    • Respectful communication
    • Zero tolerance for abusive or unsafe behaviour

    Services may be paused or terminated if safety or boundaries are compromised.

    14. Changes to Services

    Positively Living may update services, fees, or these terms from time to time. Any significant changes will be communicated.

    15. Agreement

    By engaging with Positively Living services, you acknowledge that you have read, understood, and agree to these Terms of Trade.
